These Terms and Conditions set out the basis on which Rubbish Clearance Crystal Palace provides waste removal and related services to domestic and commercial customers. By booking a collection or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

1. Definitions

In these Terms and Conditions, the following words have the meanings given below:

1.1 We, Us, Our means Rubbish Clearance Crystal Palace, the service provider supplying waste clearance and related services.

1.2 You, Your, Customer means the person, company or organisation that books or receives services from us.

1.3 Services means any rubbish clearance, waste removal, waste collection, loading, transport, disposal, recycling or related services we provide.

1.4 Waste means any items, materials, goods or refuse you ask us to collect and remove as part of the services.

1.5 Order means a booking or request for services made by you and accepted by us in accordance with these terms.

2. Scope of Services

2.1 We provide waste removal and rubbish clearance services, including but not limited to household clearances, garden waste removal, office and commercial clearances, bulky waste collection and general rubbish collection.

2.2 We will collect waste from your premises or another agreed location and will transport it for lawful disposal, treatment or recycling at an authorised facility.

2.3 We reserve the right to refuse to remove any waste that we reasonably believe is hazardous, unsafe, prohibited by law or outside the agreed scope of services.

2.4 Any description of services on our website, advertising materials or price guides is for general information only. The precise nature and extent of the services will be confirmed at the time of booking and may be adjusted on arrival after inspection of the waste.

3. Booking Process

3.1 You may request a booking by telephone, email or through any online enquiry or booking system we provide.

3.2 When requesting a booking, you must provide accurate and complete information, including the type and approximate volume of waste, the collection address, access details, any parking restrictions and any relevant safety information.

3.3 Any quotation provided before our arrival is based on the information you give us. If on arrival we find that the waste volume, type or access differs significantly from what was described, we may revise the quotation accordingly, and you will have the option to accept the revised price or cancel the service.

3.4 Your order is accepted, and a contract is formed when we confirm the booking by telephone, email or written message, or when we attend your premises to perform the services, whichever occurs first.

3.5 We will use reasonable efforts to attend your premises at the agreed date and time, but all attendance times are estimates and may be subject to change due to traffic, weather or operational issues. We will notify you of any significant delay where reasonably possible.

4. Access and Customer Responsibilities

4.1 You must ensure that we have safe, reasonable and lawful access to the premises and to the waste to be collected.

4.2 You are responsible for obtaining any necessary permissions, permits or authorisations for us to attend the premises, including any building access and local parking arrangements.

4.3 If parking charges, congestion charges or similar costs are incurred in attending your premises, these may be added to your invoice unless otherwise agreed in advance.

4.4 You must ensure that all waste for removal is clearly identified and is separated from any items that you wish to keep. We will not be liable for removing items that were not clearly identified as items to be retained.

4.5 If our staff believe that access is unsafe, unlawful or likely to cause damage to property or vehicles, we may decline to perform all or part of the services until safe access is provided. In such circumstances, a call-out or cancellation charge may apply.

5. Waste Types and Prohibited Items

5.1 We collect most general household, garden and commercial waste, including furniture, appliances, rubble in reasonable quantities, green waste and general rubbish.

5.2 Certain materials will only be collected by prior arrangement, and may be subject to additional charges, including but not limited to fridges and freezers, mattresses, tyres, plasterboard, paint, and electrical and electronic equipment.

5.3 We do not normally collect hazardous or specialist waste, such as asbestos, clinical or medical waste, chemicals, solvents, oils, pressurised containers, gas bottles, explosives or radioactive materials. If such items are discovered among the waste, we may refuse the entire load, or remove them only if separately agreed and subject to additional charges and legal requirements.

5.4 You are responsible for informing us in advance of any potentially hazardous, sharp or dangerous items within the waste, and for packaging or presenting them safely where reasonably possible.

6. Pricing, Quotations and Payments

6.1 Our prices are generally based on the volume of waste collected, its weight, the type of materials, ease of access and the time required to complete the job.

6.2 Any quotation given before we physically inspect the waste is an estimate only, based on the information you provide. We reserve the right to adjust the price once we have seen the waste in person.

6.3 Unless otherwise agreed in writing, payment is due at the time the services are completed, and before our team leaves the premises.

6.4 We accept common payment methods such as cash, bank transfer or card payment, subject to availability and any limitations we notify you of at the time of booking or collection.

6.5 All prices quoted are exclusive of any applicable taxes or charges that we are legally required to apply, which will be added to your invoice where relevant.

6.6 If payment is not made when due, we reserve the right to charge interest on overdue amounts at the statutory rate until payment is received in full, and to recover all reasonable costs incurred in pursuing the debt.

7. Cancellations, Rescheduling and Waiting Time

7.1 You may cancel or reschedule a booking by giving us reasonable notice by telephone or email.

7.2 If you cancel more than 24 hours before the agreed attendance time, no cancellation fee will normally be charged.

7.3 If you cancel less than 24 hours before the agreed attendance time, or if we attend and are unable to carry out the services due to circumstances within your control, we reserve the right to charge a reasonable cancellation or call-out fee to cover our costs.

7.4 If our team arrives on time and is kept waiting because access is not available or the waste is not ready for collection, we may charge a waiting time fee after a fair grace period.

7.5 We may cancel or reschedule a booking where we are unable to perform the services due to circumstances beyond our reasonable control, including severe weather, accidents, vehicle breakdowns, staff illness, safety concerns or legal restrictions. In such cases, we will not be liable for any resulting losses but will offer an alternative appointment where possible.

8. Performance of Services and Property Protection

8.1 We will carry out the services with reasonable care and skill, using competent personnel and suitable vehicles and equipment.

8.2 Our team will take reasonable care to avoid damage to property while collecting and removing waste. However, clearance work can involve moving bulky, heavy or dirty items through tight spaces, and there is a risk of minor scuffs, marks or cosmetic damage.

8.3 You should take reasonable steps to protect flooring, walls, fixtures and fittings where possible before our arrival, and move any delicate or valuable items out of the clearance route.

8.4 We accept no liability for pre-existing damage or wear and tear, or for minor cosmetic damage that could not reasonably have been avoided when performing the services with appropriate care.

9. Title and Risk in Waste

9.1 Once payment has been made and the waste has been loaded onto our vehicle, title and risk in the waste passes from you to us.

9.2 After waste has been removed, you no longer have any right to reclaim it, and we may transport, treat, recycle or dispose of it in accordance with applicable law and our operational practices.

10. Compliance with Waste Regulations

10.1 We operate in accordance with applicable waste management laws and regulations in the United Kingdom, including duty of care requirements and any licensing or registration obligations that apply to carriers of controlled waste.

10.2 We will transport your waste only to authorised facilities for recycling, recovery or disposal, and will use reasonable efforts to maximise recycling and minimise landfill where practicable.

10.3 Where required, we will complete any necessary documentation, such as waste transfer notes, in compliance with relevant regulations.

10.4 You confirm that you have the legal right to authorise us to remove the waste from the premises, and that the waste is not stolen, unlawfully obtained or subject to any third-party claim.

11. Liability and Limitations

11.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

11.2 Subject to clause 11.1, we shall not be liable to you for any loss of profits, loss of business, loss of opportunity, loss of data, or any indirect, special or consequential losses arising out of or in connection with the services.

11.3 Subject to clause 11.1, our total aggregate liability to you arising out of or in connection with any single job or series of connected jobs shall not exceed the total amount paid or payable by you for the services giving rise to the claim.

11.4 We will not be liable for any delay or failure to perform the services to the extent caused by events or circumstances beyond our reasonable control, including but not limited to adverse weather, traffic disruption, accidents, strikes, acts of government or failure of third-party suppliers.

12. Complaints and Disputes

12.1 If you are dissatisfied with any aspect of our services, you should notify us as soon as reasonably practicable, giving full details of the issue.

12.2 We will investigate your complaint and, where appropriate, may offer to remedy the issue by re-attending, providing a partial refund or taking other reasonable steps.

12.3 Raising a complaint does not entitle you to withhold payment for services properly performed, unless we expressly agree otherwise in writing.

13. Data Protection and Privacy

13.1 We will collect and use your personal information only as necessary to administer your booking, provide the services, process payments and handle any queries or complaints.

13.2 We will keep your information secure and will not sell your details to third parties. We may share your information with trusted partners or service providers where required to deliver our services or comply with legal obligations.

14. Changes to These Terms

14.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect when published on our website or otherwise notified to you.

14.2 The Terms and Conditions in force at the time you place your order will apply to that order and the corresponding services.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, that provision shall be deemed deleted, but this shall not affect the validity and enforceability of the remaining provisions.

16.2 No failure or delay by us to exercise any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

16.3 You may not transfer or assign your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations where reasonably necessary in the course of our business.

16.4 These Terms and Conditions, together with any confirmed quotation or written agreement, constitute the entire agreement between you and us in relation to the services, and supersede any prior discussions, correspondence or understandings.
